By participating in Lazy Otter SUP Rentals activities, I understand and agree to the following:
Acknowledgement of Risks: I acknowledge that paddleboarding and related activities involve inherent risks, including but not limited to:
Drowning and other water hazards.
Injuries from equipment and other participants.
Encounters with wildlife and insects.
Weather conditions and limited access to immediate medical aid.
I understand these risks and confirm that my participation is voluntary, despite these potential dangers. I assume full responsibility for any injury, paralysis, or death that may occur.
Assumption of Risk and Voluntary Participation: I am voluntarily using the services of Lazy Otter SUP Rentals with full knowledge of the inherent risks. I believe I have the necessary physical condition and skills for safe participation.
Waiver and Release of Liability: I HEREBY WAIVE AND RELEASE FROM LIABILITY AND AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS Lazy Otter SUP Rentals, a DBA of The Lake Day Collective, LLC, their directors, officers, agents, employees, and volunteers from any and all claims, actions, lawsuits, liabilities, expenses (including attorney's fees) arising from my participation, including any NEGLIGENCE. This includes, but is not limited to, claims for injury, paralysis, death, or property damage, whether foreseen or unforeseen, resulting directly or indirectly from my participation or the use of equipment, even if caused by negligence. I agree not to sue Lazy Otter SUP Rentals for any such occurrences.
Agreement: I have carefully read, understand, and voluntarily agree to this Waiver and Release Agreement and the Rental Agreement on behalf of myself and any minor participants under my supervision.
Responsibility for Minors: If I am signing this waiver on behalf of a minor, I acknowledge that I am the parent or legal guardian of the minor and I understand and agree that I assume full responsibility for all liability and obligations of the minor as described in this waiver
